Land valuation in expropriation processes in France

Expropriation procedures in France have developed following diverse norms that give an indication of the interest, on the part of the state, to cover in a fair and integral form, the damages occasioned by the persons affected by the expropriation, through the compensations. The crucial theme in these expropriation processes is the determination of the level of the different compensations, through which the rights and obligations of those persons expropriating, as much as those affected by the expropriation, are exposed in order to understand the complexities of the valuation of a property affected by compulsory expropriation. Nevertheless, in spite of the regulatory changes having taken place over the last few decades, last decades, an inequality still exists between both parts (the expropriating part and the part affected by the expropriation), giving rise to a certain legal weakness. The paper is organised in three sections: 1) the expropriation procedures; 2) indemnity of harm; and finally 3) conclusions relating to confidence in the processes. / Les procédures d’expropriation en France ont été développées après diverses normes qui nous rendent compte de l'intérêt, par l'état, pour couvrir de façon intégrale et adéquat, les préjudices provoqués à l’exproprié, à travers des indemnisations. La question cruciale dans ces processus d’expropriation est la détermination du montant des différentes indemnisations qui interviennent, pour tant on expose les droits et les devoirs autant de l’expropriant comme des expropriés pour ainsi pouvoir comprendre les complexités de l'évaluation d'une propriété touchée par la dépossession forcée. Toutefois, malgré l'évolution normative des dernières décennies, il existe encore une inégalité entre les deux parties (expropriante - exproprié), en laissant entrevoir une certaine inconsistance légale. L'article est organisé en trois paragraphes: 1) les procédures d’expropriation, 2) indemnisation de préjudice et 3) finalement conclusions par rapport à la confiance des processus.Downloads
